1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Starso ("Company," "we," "us", or "our"), concerning your access to and use of the Bolo Thrift mobile application and related services (collectively, the "Service").

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. Description of Service

Bolo Thrift is a software-as-a-service (SaaS) application that uses artificial intelligence to identify thrift items and estimate their market value based on images submitted by users. The Service utilizes various third-party cloud infrastructure and AI model providers to deliver its functionality.

3. Accounts and User Responsibilities

3.1 Access Methods

The Service requires authentication via supported third-party providers (e.g., Apple Sign-In).

  • You are responsible for maintaining the security of your authentication credentials.
  • You must provide accurate and complete information when creating an account.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Subscriptions, Fees, and Payment

4.1 Subscription Plans

The Service acts as a "Freemium" service. We offer a limited free tier with a restricted number of item identifications. Continued access to unlimited identifications and advanced features requires a paid subscription ("Pro Subscription").

4.2 Billing and Cancellation

Subscriptions are managed and billed through the platform provider (e.g., Apple App Store). All payments are subject to the terms and conditions of the respective platform. You may cancel your subscription at any time through your platform account settings. Cancellation will take effect at the end of the current paid term.

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE, EXCEPT AS REQUIRED BY APPLICABLE LAW OR THE STORE POLICY.

4.3 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect active subscription periods.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

  • Upload infringing, offensive, inappropriate, or illegal images
  • Attempt to circumvent usage limits or subscription restrictions
  • Reverse engineer, decompile, or attempt to extract source code from the Application
  • Use the Service to collect or store others' personal information without consent
  • Comply with all applicable local, state, national, and international laws

6. AI-Powered Identification

6.1 Service Description

Item identification is performed using third-party AI models. Identifications are provided for informational purposes only. The Service does not guarantee accuracy of identifications or value estimates.

6.2 Limitations

  • AI identifications may be incorrect or incomplete
  • Market value estimates are approximations and may not reflect actual resale value
  • Users should not rely solely on the Service for purchasing or selling decisions
  • We are not liable for financial losses resulting from reliance on identification or valuation information

7. User Content

7.1 Ownership

  • You retain ownership of images you upload to the Service
  • By uploading images, you grant us a limited license to process them for identification purposes

7.2 Prohibited Content

You may not upload content that:

  • Infringes intellectual property rights of others
  • Contains nudity, violence, or sexually explicit material
  • Promotes hate speech, discrimination, or harassment
  • Depicts illegal activities or items
  • Violates the privacy or publicity rights of others

8. Data Storage

8.1 Local Storage

  • Collection items and images may be stored locally on your device
  • Local data is only accessible on the device where it was created
  • You are responsible for backing up your device data

8.2 Cloud Storage

  • User account information and subscription status are stored using third-party cloud services
  • Images submitted for identification are transmitted to third-party AI processors and are not retained on our servers

9. Intellectual Property

9.1 Application Ownership

Unless otherwise indicated, the Service is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service (collectively, the "Content") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

9.2 Trademarks

  • "Bolo Thrift" and related logos are trademarks of Starso
  • You may not use our trademarks without written permission

10. Third-Party Services

The Service integrates with the following categories of third-party services:

  • Cloud infrastructure and authentication providers
  • AI image analysis and processing providers
  • Subscription and payment management services
  • App store platforms (e.g., Apple App Store)
  • Push notification services

These services are subject to their own terms and privacy policies. We are not responsible for their independent data handling practices.

  • Information provided is for educational and informational purposes only

11.2 Accuracy Disclaimer

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICE'S CONTENT OR THE OUTPUT GENERATED BY AI MODELS (WHICH MAY CONTAIN ERRORS OR "HALLUCINATIONS").

12. Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the Service; (2) breach of these Terms; (3) any breach of your representations and warranties set forth in these Terms; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Service.

14. Termination

We may terminate or suspend your access to the Service:

  • For violations of these Terms
  • For fraudulent or illegal activities
  • For uploading prohibited content
  • At our sole discretion, with or without cause
  • Without prior notice

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via updates to the "Last Updated" date or in-app notifications for significant changes. Continued use of the Application after changes constitutes acceptance of the new Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and defined following the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Binding Arbitration: Any dispute arising from the relationships between the Parties to this contract shall be determined by binding arbitration. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association.

Class Action Waiver: Any arbitration under these Terms will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted.
